Terms of Service

Commission and Freelance Terms of Service, Payment Process, and Privacy Policy

The following applies to freelance and commissioned work that is purchased by a specific client or group(s) and is made to their specifications. It does not apply to other artwork I create, such as personal art or fan art, and does not apply to resources I have made. If anything in this section is unclear, the short form is: artwork made for a client is for that client's use, so don't take it.

Overview:

You, as client, will have to have read these terms of service. By asking me to work for you, you confirm you've read and agreed to these rules.

I reserve the right to refuse any commission without explanation before payment, or to cancel and refund if payment, partial or full, has occurred.

Being rude, inappropriate or otherwise offensive will not be tolerated and may result in you losing your place as one of my clients.

Usage of my work in AI, NFT, crypto or other techbro shenanigans is not allowed.

I will not knowingly work for clients that promote, create, or otherwise condone pedophilia, predatory age gaps, or sexualization of things related to childhood; incest; abuse and / or sexual abuse; hate speech or hate symbols; bigotry in all forms, including but not limited to: sexism, racism, xenophobia, islamophobia, antisemitism, and LGBTphobia; bestiality / zoophilia or themes related to bestiality / zoophilia, including fictional feral creatures; real-world cops and/or the military.

I reserve the right to edit this list of blacklisted themes without explanation.

Breaking these terms will result in declined, refunded or cancelled commissions and / or blacklisting. In severe cases and when necessary, other artists will be notified.

Adoptables & other Designs I have created

The following applies to designs I have created and sold either as my own work, in collaborations with other artists, and as commissioned custom work. This does not apply to other content I create, such as commissioned art for clients, personal art, or fan art. If another artist or group's Terms of Use apply (for example, with design collaborations or for designs made for closed groups with specific rules) those rules apply in addition to my own, and anything banned by their terms overrules allowed on my own.

When using my designs, you can:

• Credit me (and any collaborators, unless stated otherwise) via link (nidoskull.neocities.org) and/or applicaible mention/tag on social media sites where I am present, when the original design art is posted and on any applicable reference sheets or reference hosting sites like Toyhouse or Refsheet. This is mandatory.
• Resell purchased designs for the purchase price plus the value of any additional content (commissioned or self-created).
• Make edits to the design and / or create alternate forms of the design with your own art being used for these edits.
• @ / mention me in art posted of the character (not mandatory, I just think it's neat!)
• Create NSFW content of designs that are not made in collaborations with an artist who is underage or does not permit explicit content of their work.

When using my designs, you can not:

• Resell purchased designs for higher than the purchase price without additional content.
• Knowingly sell or transfer designs to people who promote or create content that positively represents or condones any of the items on my blacklist.
• Make edits to my original art.
• Add or include hate speech or intentionally offensive imagery to the design.
• Create suggestive or explicit content of designs made in collaboration with artists who are underage or do not permit explicit content of their work.
• Sell, trade, gift or otherwise transfer designs with suggestive or explicit content to minors.
• Use for / in NFTs or other cryptocurrency / blockchain / bitcoin-related transactions, or use in AI generation, as a prompt, training algorithms or otherwise, to any extent.
